1. Policy Statement
SwapZilla is committed to preventing money laundering, terrorist financing, sanctions evasion, and other illegal financial activities. SwapZilla is a rate-aggregation and payment-routing platform; it does not hold User funds. KYC/AML screening is performed by the third-party Providers that execute Swaps and by the Merchants that operate Pay accounts. This Policy applies to all of SwapZilla's products: Swap, Private Swap, and Pay.
2. Provider-Level Screening
Providers employ automated AML/KYC screening systems. If a transaction is flagged as high-risk or suspicious by a Provider, the Provider may:
- Suspend the transaction;
- Request additional information from the User (KYC);
- Refuse to execute the swap and return funds to the refund address.
SwapZilla does not control these decisions and acts as an intermediary in communication only. Providers are listed in our public quote feed with a KYC rating that you can use to choose your route.
3. Private Swap — Heightened Scrutiny
Private Swap routes Exchanges through Monero (XMR). Because Monero is a privacy coin, both legs of the route may be subject to stricter Provider-level controls than a regular Swap, including additional source-of-funds requests. SwapZilla itself does not provide privacy guarantees beyond the routing topology described in our Terms; using Private Swap to obscure proceeds of crime, evade sanctions, or evade tax obligations is strictly prohibited. Privacy coins, including Monero, are regulated or prohibited in some jurisdictions (for example, but not limited to, Japan and South Korea). You are solely responsible for verifying that your use is lawful in your jurisdiction.
4. Restricted Jurisdictions
The Service is not offered to Users located in or resident of jurisdictions subject to comprehensive sanctions administered by the United Nations, OFAC, the European Union, or the United Kingdom — including, without limitation: Iran, North Korea, Syria, Cuba, Crimea, and the so-called "Donetsk People's Republic" / "Luhansk People's Republic" and other Russian-occupied regions of Ukraine. Transactions associated with sanctioned persons or entities will be refused at the Provider level and may be reported to the relevant authorities.
5. Merchant Obligations (Pay Service)
Merchants using the Pay Service represent and warrant that they:
- Comply with their local KYC, AML, counter-terrorist-financing, and sanctions obligations;
- Do not accept payment for goods or services that are illegal in the Merchant's or the Payer's jurisdiction;
- Maintain appropriate records of transactions for tax and regulatory purposes;
- Promptly report suspicious activity to the relevant authorities as required by their jurisdiction.
SwapZilla may suspend Merchant accounts where there is reasonable suspicion of misuse and may cooperate with law-enforcement requests as required by applicable law.
6. Prohibited Activities
Users are strictly prohibited from using the Service for funds derived from criminal activities, sanctioned addresses, darknet markets, or any activity prohibited by applicable law. Any attempt to use the Service for money laundering, terrorist financing, sanctions evasion, or fraud will result in immediate termination of access and potential reporting to the relevant authorities.
